Terms and conditions

Last updated

These terms apply to every tour MudShark ehf. sells. By booking a tour you accept them.

  1. 1.About us

MudShark ehf., reg. no. 440214-0530, VAT no. 116193, Freyvangur 22, 850 Hella, Iceland. The company holds day tour provider licence no. 2019-046 from Ferðamálastofa, the Icelandic Tourist Board, and passenger transport licence no. 1930 from Samgöngustofa, the Icelandic Transport Authority, under act no. 28/2017.

  2. 2.Booking

You book through the website, by email or by phone. A booking is confirmed when we send you a confirmation by email with a booking reference.

Online booking closes 48 hours before departure, which is also when the full refund ends. For a tour sooner than that, email or call us.

Every tour is private, for up to six guests in one vehicle. Larger groups receive a separate quote.

There is no minimum age. A child takes one of the six seats, with or without a car seat. MudShark does not provide child seats. If a child needs a car seat or booster, bringing it is the parents' responsibility.

The Land Rover is raised and modified, and the step up into it is high. If anyone in your group may find that difficult, contact us before you book.

  3. 3.Prices and payment

    • Prices are in Icelandic krónur (ISK) and include VAT.
    • Each price is for the whole tour: the vehicle and the guide, for up to six guests. It is not charged per person.
    • Full payment is required to confirm your private tour. The booking is confirmed once the payment has been received.
    • When you pay on the website, you pay by card through Teya, and we never see the card number. For a booking made by email or phone, or a booking request sent through the website, we email you how to pay.
    • All payments and refunds are made in ISK.
  4. 4.If you cancel

Cancellations must be made in writing to mudshark@mudshark.is or by phone on +354 691 1849. A reply to your booking confirmation counts as writing. The time MudShark receives the cancellation is the time that counts: when the email arrives, or when you call.

    • Cancellations received at least 48 hours before departure are fully refundable.
    • Cancellations made within 48 hours of departure are non-refundable.

No-shows are non-refundable: a guest who does not turn up at the agreed place and time is not refunded.

Refunds go back to the card or account the payment came from.

The 14-day right of withdrawal for consumers does not apply to leisure services booked for a specific date (article 18 of the Icelandic Consumer Contracts Act, no. 16/2016).

  5. 5.Weather, roads and changes

Highland tours and river crossings depend on the weather and the state of the roads. The guide assesses conditions on the morning of the tour and may change the route or shorten the day if safety requires it.

MudShark may have to cancel a tour, for example because of the weather, road conditions, a breakdown, illness or a double booking. Whatever the reason, we contact you by email or phone as soon as we know and offer you another date. If no date suits you, you get a full refund.

We are not liable for other costs a cancellation may cause, such as accommodation or flights.

  6. 6.On the day

    • We pick guests up from their accommodation in the Hella–Hvolsvöllur region at no extra cost. Pickup outside that area is available by arrangement, agreed with Magnús each time before you book, including any extra cost.
    • Dress for the weather: warm layers, waterproofs and sturdy shoes.
    • Guests must follow the guide's safety instructions. The guide may refuse to carry anyone who is under the influence of alcohol or drugs, or who puts themselves or others at risk. No refund is given in that case.
  7. 7.Liability and insurance

The vehicle carries the insurance required by law, with VÍS (Vátryggingafélag Íslands hf.), and that insurance covers passengers. We recommend that guests have their own travel insurance.

We are not liable for guests' personal belongings unless the loss is caused by our negligence. Nothing in these terms limits a consumer's rights under the law.

  8. 8.Complaints and disputes

If something goes wrong, we want to know as soon as possible, ideally during the tour so it can be put right. Written complaints go to mudshark@mudshark.is.

If we cannot agree, consumers can refer the matter to the Icelandic Complaints Committee on Goods and Services (kærunefnd vöru- og þjónustukaupa). These terms are governed by Icelandic law, and disputes may be brought before the District Court of South Iceland.

  9. 9.Changes to these terms

Each booking is governed by the terms in force on the day it was confirmed.
